These Terms of Service (“Terms”) govern your use of lacascios.com (the “Site”), operated by LaCascio’s Scratch Italian (“we,” “us,” “our”). By using the Site you agree to these Terms.
1. Use of the Site
You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:
- Copy, modify, or republish content from the Site without written permission
- Use the Site to violate any law
- Attempt to gain unauthorized access to the Site, our systems, or other users’ accounts
- Interfere with the Site’s normal operation (e.g., scraping at high volume, denial-of-service attempts)
- Use automated tools to harvest personal information from the Site
- Submit false, misleading, or fraudulent information through any contact or inquiry form
2. Reservations, Orders, and Catering
Reservations, including those made through the reservation window on our Site, are powered by Toast (toasttab.com) under their own terms. We honor reservations on a best-effort basis and reserve the right to modify, decline, or cancel a reservation in extraordinary circumstances (capacity issues, restaurant closure, force majeure, etc.).
Online orders placed through the Toast online ordering platform are subject to Toast’s terms and our restaurant’s pickup or delivery policies. Pricing, availability, and menu items are subject to change without notice.
Catering and event inquiries submitted through the Site are not contracts. A signed catering or event agreement, plus any required deposit, must be in place before we are obligated to provide services for your event.
3. Gift Cards
Gift cards are issued and redeemed through Toast and subject to Toast’s gift card terms. Gift cards are non-refundable, are redeemable only for food and beverage at LaCascio’s, and do not expire (in compliance with Texas law).
4. Menu, Pricing, and Availability
Menu items, prices, hours, and availability are subject to change. The menus shown on the Site are updated automatically from our Toast point-of-sale system several times a day; even so, we cannot guarantee real-time accuracy. The menu shown at the restaurant on the day of your visit governs.
Some items may have limited availability or be unavailable due to seasonal sourcing. Allergen and dietary information should be confirmed with your server. Please notify us of any allergies before ordering.
5. Reviews and User Content
The Site may display third-party reviews (e.g., Google reviews) for informational purposes. Those reviews are the opinions of their authors and not statements by LaCascio’s.
If you submit a comment, photo, testimonial, or other content through the Site or social media tagging us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with marketing the restaurant. You represent that you have the right to grant this license.
6. Intellectual Property
All content on the Site, including text, photographs, illustrations, logos and design, is owned by LaCascio’s or licensed to us, and is protected by U.S. copyright and trademark law. “LaCascio’s Scratch Italian” and our logos are trademarks of LaCascio’s.
You may share links to the Site freely. You may not reproduce, republish, or create derivative works of Site content without our written permission.
7. Third-Party Links and Services
The Site links to and embeds third-party services (Toast, Google Maps, Instagram, Facebook, TrustIndex). We are not responsible for the content, privacy practices, or policies of those third parties. Your use of those services is at your own risk and governed by their terms.
8. Disclaimer of Warranties
The Site is provided “as is” and “as available.” We make no warranties, express or implied, about the Site’s operation, the accuracy of information shown, or the availability of menu items. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, LaCascio’s, its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to the Site is limited to one hundred U.S. dollars ($100).
This Section does not limit liability that cannot be limited by Texas law (e.g., gross negligence, intentional misconduct).
10. Indemnification
You agree to indemnify and hold harmless LaCascio’s, its owners, employees, and contractors from any claim, loss, or expense arising out of your violation of these Terms or your misuse of the Site.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Site shall be resolved exclusively in the state or federal courts located in Smith County, Texas, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the new Terms.
